Concidiones de compra
Objeto
Las presentes Condiciones Generales de Contratación tienen como objeto regular la relación entre Cuento A2lenguas, S.L. (en adelante la Compañía) y Vd. (en adelante el Cliente), relativas a todas las transacciones realizadas en el sitio Web www.a2lenguas.com, dominio del que es titular La Compañía, sociedad legalmente constituida, provista de CIF número B-93109833.
Aceptación
La adquisición de los productos deberá hacerse a través de la activación del botón ENVIAR que aparece a pie de página de la solicitud de compra, y expresa la aceptación total de todas y cada una de las Condiciones Generales de Contratación tal y como se muestran en el sitio Web de la Compañía www.a2lenguas.com, con anterioridad a la adquisición de los productos, sin que le sean de aplicación las novedades que puedan producirse en el clausulado de las Condiciones Generales de Contratación con posterioridad.
Desde el momento de la aceptación, el usuario adquiere la condición de Cliente de la Compañía que se describe en estas Condiciones Generales de Contratación. Cualquier producto ofertado con posterioridad por la Compañía deberá ser objeto de una nueva contratación.
Precios, forma de pago, entrega y desistimiento
Precios:
Los precios aplicables a cada producto son los indicados en el sitio Web en la fecha del pedido incluyendo todos ellos el IVA (Impuesto sobre el Valor Añadido). Las ofertas estarán debidamente marcadas e identificadas como tales, indicando convenientemente el precio anterior y el precio de la oferta.
La Compañía se reserva el derecho de efectuar, en cualquier momento y sin previo aviso, las modificaciones que considere oportunas, pudiendo actualizar diariamente productos y servicios en función del mercado.
Los gastos de envío correspondientes siempre se indican en el pedido. En los envíos realizados a países no pertenecientes a la Unión Europea, Cuento A2lenguas, S.L. no asumirá los gastos correspondientes a impuestos y aranceles aduaneros propios de cada país.
Los gastos de envío que aparecen en el sitio Web al realizar el pedido son orientativos y se calculan en base a un peso estadístico medio por libro (500 grs). Cuento A2lenguas, S.L. se reserva el derecho a alterar los costes de envío cuando el peso de los libros solicitados varíe en más/menos un 10% con respecto al peso medio mencionado. En caso de producirse una variación de precio, la Compañía comunicará por medio de correo electrónico al Cliente la variación y el Cliente podrá optar por anular su pedido sin que se le pueda imputar ningún coste adicional.
Forma de pago
Todas las compras se pueden pagar, a través de Pay Pal, quien garantiza la seguridad en la fórmula del pago.
Entrega
El Cliente podrá seleccionar la forma de envío de entre las posibles para su zona de envío. Deberá tener en cuenta que los plazos de entrega, la calidad del servicio, el punto de entrega y el coste serán diferentes para cada forma de transporte.
La Compañía envía los pedidos a sus clientes a través de diferentes empresas de transporte urgente de reconocido prestigio nacional e internacional. La fecha de entrega en el domicilio del Cliente depende de la disponibilidad del producto escogido y de la zona de envío. Antes de confirmar su pedido se le informará sobre los plazos de transporte. No obstante, ambos podrán variar en función de las circunstancias concretas de cada pedido. En especial, los plazos de transporte se pueden ver alterados por incidencias extraordinarias en el transportista y por dificultades en la entrega de la mercancía.

Desistimiento
La Compañía garantiza al Cliente la posibilidad de anular su pedido en cualquier momento (a excepción de compras de eBooks) y sin ningún coste siempre que la anulación se comunique antes de que el pedido haya sido puesto a disposición del transportista para su envío. En caso contrario deberá esperar a recibir el pedido para tramitar su devolución. En el caso de compras de eBooks no es admitida devolución una vez activada la descarga.
El Cliente dispondrá de un plazo de siete días hábiles desde la recepción del pedido para resolver el contrato y realizar la devolución del producto adquirido (a excepción de eBooks). El Cliente comunicará a la Compañía dentro del plazo estipulado y por cualquier medio admitido en derecho, su deseo de ejercitar el derecho de resolución del contrato. El pedido devuelto deberá se entregado junto con el albarán de entrega y en su caso factura emitida por la Compañía, corriendo la Compañía con los gastos de devolución. En estos casos, la Compañía devolverá el dinero de la compra a través de transferencia bancaria a la cuenta indicada por el cliente, giro postal o mediante abono en su cuenta personal.
El Cliente podrá devolver cualquier artículo que haya comprado a la Compañía siempre y cuando los productos no hayan sido abiertos ni usados y conserven su precinto o embalaje original. En estos casos, la Compañía, devolverá el dinero de la compra mediante una transferencia bancaria a la cuenta indicada por el Cliente o mediante abono en su cuenta personal.
Si un producto distinto al solicitado por el cliente fuera entregado por error de la Compañía, se le entregará el producto correcto, recogiendo el primero, sin ningún cargo adicional para el Cliente.
Si un producto ha llegado al cliente roto, dañado o en malas condiciones, la Compañía se hará cargo de recogerlo en su domicilio, sustituyéndolo por otro en buen estado, sin cargos adicionales.
La Compañía hace todos los esfuerzos dentro de sus posibilidades, para ofrecer la información contenida en el sitio Web de forma veraz y sin errores tipográficos. En el caso que en algún momento se produjera algún error de este tipo, ajeno en todo momento a la voluntad de la Compañía, se procedería inmediatamente a su corrección. De existir un error tipográfico en alguno de los precios mostrados y en el caso de que algún Cliente hubiera tomado una decisión de compra basada en dicho error, la Compañía le comunicará dicho error y el Cliente tendrá derecho a rescindir su compra sin ningún coste por su parte.
Los contenidos del sitio Web pueden, en ocasiones, mostrar información provisional sobre algunos productos. En el caso que la información facilitada no correspondiera a las características del producto el Cliente tendrá derecho a rescindir su compra sin ningún coste por su parte.

Requerimientos del servicio
Para la adquisición de productos y/o servicios, se requiere exclusivamente rellenar el formulario de compra con los datos personales y los datos de pago.
Una vez recibida una Orden de Compra, la Compañía remitirá de forma inmediata al Cliente una confirmación de la compraventa realizada a la dirección de correo electrónico indicada en la Orden de Compra.
Responsabilidad de la Compañía
La disponibilidad de la tienda depende directamente del estado de los sistemas de telecomunicación empleados para su publicación, y en particular de la red de Internet, por lo que la Compañía no puede responsabilizarse de las interrupciones, demoras, errores y demás inconvenientes que tengan su origen en causas que escapan a su control o al de sus proveedores informáticos, entre las que figurarán también los problemas derivados del software de conexión, sistema informático, módem, fluido eléctrico, o redes de telecomunicaciones.
Responsabilidades del cliente
El Cliente se obliga a realizar un uso lícito de los Servicios, sin contravenir la legislación vigente, ni lesionar los derechos e intereses de terceras personas.
El Cliente garantiza la veracidad y exactitud de los datos facilitados al cumplimentar los formularios de contratación, evitando la causación de perjuicios a la Compañía producto de la incorrección de los mismos.
Asimismo, se compromete a posibilitar la entrega del pedido solicitado facilitando una dirección de entrega en la que pueda ser entregado el pedido solicitado dentro del horario habitual de entrega de mercancías (de lunes a viernes de 10:00 a 13:30 y de 16:00 a 18:00).
El incumplimiento de cualquiera de estas Condiciones podrá dar lugar a la retirada o cancelación de los Servicios por parte de la Compañía sin necesidad de preaviso al Cliente y sin que ello le dé derecho a indemnización alguna.
Datos personales y comunicaciones comerciales
De conformidad con lo establecido en la Ley Orgánica 15/1999 de 13 de diciembre, de Protección de Datos de Carácter Personal, se informa al Cliente de que los datos personales que nos facilita como consecuencia de la compra de un producto, serán incluidos en un fichero titularidad de la Compañía, con la finalidad de realizar una correcta gestión de la relación comercial, así como para informarle de novedades, productos y/o servicios tanto por medios escritos como electrónicos.
Propiedad industrial e intelectual

Jurisdicción y ley aplicable

En el supuesto de que surja cualquier conflicto o discrepancia en la interpretación o aplicación de las presentes condiciones, los Juzgados y Tribunales que, en su caso, conocerán del asunto, serán los que dispongan la normativa legal aplicable en materia de jurisdicción competente, en la que se atiende, tratándose de consumidores finales, al lugar del cumplimiento de la obligación o al del domicilio de la parte compradora.
Todo ello sin perjuicio de la facultad del cliente de acudir a la Junta Arbitral de Consumo de su demarcación.
En el caso de que se trate de una compraventa realizada por una empresa, ambas partes se someten, con renuncia expresa a cualquier otro fuero, a los Juzgados y Tribunales de Madrid (España)
Políticas de devoluciones y anulaciones
Nuestra política, cumpliendo con la normativa vigente, es concederle el derecho de devolver cualquier libro en el plazo de 7 días desde la fecha de recepción. No tendrá que aportar ninguna explicación, cualquier libro devuelto en condiciones normales (con su packaging original y sin usar)será aceptado sin más. En un plazo máximo de 30 días de la recepción de la devolución, Cuento A2lenguas se compromete a su reembolso. Antes de realizar la devolución, tendrá que comunicarlo al departamento de atención al cliente y le indicaremos la forma en que puede enviarnos el pedido. Es indispensable la comunicación previa y no podremos aceptar devoluciones a portes debidos que se hayan realizado mediante un medio de transporte distinto al indicado por nosotros. Si la causa de la devolución fuese que el libro devuelto es defectuoso o no corresponde a lo solicitado en el pedido, www.a2lenguas.com correrá con los gastos de la devolución y nuevo envío. Si el motivo de la devolución es que el pedido no le satisface, le reembolsaremos el importe pero no los gastos de envío ni los gastos de devolución. La devolución de importes se realizará a través de transferencia bancaria a la cuenta indicada por el cliente, mediante giro postal o mediante abono en su cuenta personal.
Anulaciones

Gastos de envío
En los procesos de compra on-line los gastos de envío se calculan automáticamente en tiempo real para que usted pueda ver el importe total de su compra. Reclamación de pedidos no entregados
Una vez que le informemos que le enviamos su pedido, si no lo recibe en los plazos indicados anteriormente puede ponerse en contacto con nosotros y realizaremos inmediatamente la reclamación al transportista. En el caso de envíos por correo certificado, Correos se reserva un plazo para contestar a las reclamaciones de hasta 3 meses en el caso de envíos internacionales y un mes en el caso de envíos nacionales. Una vez obtenida la respuesta a la reclamación nos pondremos en contacto con usted.
Peso total del pedido
Este peso será la suma de los pesos individuales de los libros mas el peso del embalaje.
Otras consideraciones
En los envíos realizados a países no pertenecientes a la Unión Cuento A2lenguas no asumirá los gastos correspondientes a impuestos y aranceles aduaneros propios de cada país.
